1. Introduction

Welcome to UrbanForestGarden ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at urbanforestgarden.sbs (the "Service") operated by UrbanForestGarden.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you do not accept these terms in full, you should not use the Service.

2. Service Overview

UrbanForestGarden offers exclusive yacht charter services, which include:

• Rentals of yachts on a daily basis
• Sunset excursions
• Events for companies
• Private gatherings
• Charters lasting several days

All offerings are contingent on availability and the conditions of the weather. We retain the right to alter or cease service offerings without previous notice.

3. Booking and Reservations

3.1 Booking Process

For charter reservations, you are required to:

• Have at least 18 years of existence
• Supply full and accurate details
• Remit the initial deposit as delineated in your reservation confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your reservation is granted upon the successful transaction of your payment and our official written confirmation. We reserve the exclusive right to deny service at our sole discretion.

3.3 Availability

Charters depend upon the availability of the yacht and appropriate weather conditions for sailing. We strive to accommodate your preferred timing and dates for the charter where possible.

4. Payment Terms

4.1 Pricing

All stated fees are denominated in € and are inclusive of applicable taxes unless stated otherwise. Prices are subject to variations at any given time and without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the total cost of the charter is due at the time of reservation
• Balance: Payable 48 hours before the planned departure of the charter
• Additional charges (if any): Payable immediately after the charter concludes

4.3 Payment Methods

We accept a variety of payment methods including major credit cards, electronic funds transfers, and certified bank checks. Our payment processes employ secure, encrypted systems for transactions.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancellation is made more than 72 hours prior to departure: a complete refund less transaction fees is issued
• If cancellation occurs between 24-72 hours before departure: 50% of payment is refunded
• If cancellation is less than 24 hours before departure: There is no refund provided

5.2 Weather Cancellations

In the event our captain deems the weather conditions unsafe, we will propose either:

• Rescheduling your charter to the nearest available slot without extra charges
• Issuing a full refund when rescheduling is not feasible

5.3 Mechanical Issues

Should a mechanical malfunction occur with the designated vessel, we will make an effort to provide a comparable substitute. When a replacement is not procurable, a complete refund will be remitted.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Comply with all instructions from the crew
• Use provided safety gear as instructed
• Communicate any medical issues that could impact their safety
• Stay within specified regions of the yacht

6.2 Prohibited Items

The following are not allowed on the yacht:

• Containers made of glass
• Contraband substances
• Firearms or other forms of weaponry
• Drinks in excess (past moderate consumption)
• Pets, unless prior approval is obtained

6.3 Conduct

Guests are expected to conduct themselves in a manner that is courteous. We retain the authority to terminate a charter prematurely with no refund if a guest's behavior endangers safety or mars the experience for other guests.

7. Liability and Insurance

7.1 Our Liability

Our responsibility is limited solely to the amount you have paid for the charter, and we are not accountable for:

• Personal injuries caused by passenger misjudgment
• Theft or damage to private belongings
• Indirect or punitive damages, or any that result from secondary consequences
• Delays attributed to weather or other factors not within our control

7.2 Insurance Coverage

Our operations and vessels are covered by extensive marine insurance policies. Passengers bear the responsibility of ensuring they have adequate personal and travel insurance.

7.3 Assumption of Risk

By engaging in our charter offerings, you recognize that activities at sea inherently come with certain risks, and you assume all responsibility for your personal well-being and safety.

8. Modifications and Itinerary Changes

We hold the right to change itineraries, paths, or schedules owing to factors such as weather, safety, or operational needs. We will endeavor to offer comparable alternatives whenever possible.

9. Force Majeure

We are not liable for any hold-ups, cancellations, or changes that occur due to factors beyond our control, such as:

• Severe weather events
• Natural catastrophes
• Governmental regulations
• Closure of docks
• Vessel breakdowns

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. Utilizing our services signifies your consent to our collection and application of your information as outlined in the Privacy Policy.

11. Intellectual Property

All intellectual content on our website, including but not limited to text, visuals, logos, and photographs, is subject to copyright and trademark protection. Unauthorized reproduction, distribution, or the making of derivative materials is not permitted without our explicit consent in writing.

12. Governing Law

These Terms are subject to the laws of Spain. Any arising disputes will be resolved in the judiciary courts located in Palma de Mallorca, Spain.

13. Changes to Terms

We reserve the right at any time to modify these Terms. When changes are made, they will be published on our site and will feature an updated revision date. Continued engagement with our services implies agreement to the revised terms.
